Obtaining Forgiveness for Student Loan Debt

When you enrolled in your first college class, you were most likely filled with great ambitions and hopes for the future, especially if your career involved public services. Whether your major involved educating the next generation, engaging with those who are disabled or elderly in supportive healthcare, or keeping the peace through law enforcement, you wanted to change the world for the better. You certainly did not expect to be thrust into an economy on the verge of recession with a mountain of student loan debt.

At McFarlin LLP, we recognize that, in our already precarious economy, the traumatic pandemic of COVID-19 has revealed more than ever that our public servants are key workers keeping our country afloat. So, if you are involved in a role of public service, why should you be forced to face the additional burden of enormous student loans when you are already doing so much to fill essential gaps in the public workplace? This is why our public service discharge attorneys in Irvine are dedicated in helping you get the financial relief you deserve.

Eligibility Standards for Public Service Loan Forgiveness

If you are involved in a public service career, you can be eligible for special loan forgiveness.

The two primary requirements for this type of loan forgiveness are:

  • Paying a total of 120 payments, on time, toward your educational loan. These monthly deposits must all be separate. While you can combine them into lump payments, a payment of $200 one month and $1000 the next will still only count as two payments (rather than the larger amount counting as 5 payments of $200). Also remember that engaging in the Standard Repayment Plan for 10 years renders the Public Service Loan Forgiveness Program obsolete in your case, simply because you would not have anything to pay back at the end of the 120 settlements.
  • Working for a qualified, registered public service company or organization as a full-time employee during these 120 payments. So long as you are an employee who is working full time at either a federal or state bureau, a county or city agency, or a non-profit group that is certified with 501 (c)(3) status, you are eligible. You need to be employed for either 30 hours a week or completing the total weekly hours designated by your employer as “full time” (whichever is the higher number).

Applying for Public Service Loan Forgiveness & Completing the Process

The loans you are eligible to use must be included under the William D. Ford Federal Direct Loan Program. Beneath this overarching branch, you could be utilizing general direct subsidized and unsubsidized loans. Direct Stafford loans, both subsidized and unsubsidized, also qualify, as do Direct PLUS loans.

After you have completed the last of the 120 loan payments, you will then complete a form certifying your employment at one of the designated agencies. Remember, this includes many non-profit agencies, such as those that offer crucial services to the public (e.g. education, care for the elderly and disabled, law enforcement, public health, etc.). Unfortunately, non-profit organizations involving politics, religious instruction, or labor unions are not eligible.

If you have changed jobs during your 120 payment plan, you must obtain proof from every one of your employers demonstrating that both your role and the organization were eligible to the program.
